Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Faithify ("Faithify," "we," "us," or "our"), governing your access to and use of the Faithify website, mobile applications, audio content, and all related services (collectively, the "Service").

By accessing or using the Service, creating an account, subscribing to a plan, or clicking any button indicating your acceptance, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

Faithify is a subscription-based audio learning platform providing Ethiopian Orthodox Tewahedo Church (EOTC) educational content, including audio storybooks, theological teachings, liturgical classes, saint stories, prayer guides, and related spiritual content (collectively, "Content") organized across four age-appropriate learning tiers.

The Service includes:

• Streaming access to 100+ hours of curated EOTC audio content
• Up to five (5) child profile slots per family subscription
• Four (4) learning tiers covering ages Pre-K through college
• Background audio playback capabilities
• Monthly addition of new content aligned with the EOTC liturgical calendar
• Parent dashboard for managing child profiles and subscriptions

To use the Service, you must be at least 18 years of age or the legal age of majority in your jurisdiction. By creating an account, you represent and warrant that you meet this eligibility requirement.

Account Security: You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately at info@faithifyz.com of any unauthorized use
• Ensuring that all account information you provide is accurate and current

You may not create more than one account per family household. You may not share, sell, transfer, or assign your account credentials to any other person. Faithify is not liable for any loss or damage arising from your failure to safeguard your account credentials.

Access to the full Faithify Service requires a paid subscription. We currently offer two subscription plans:

• Monthly Plan: $9.99 USD per month, billed monthly
• Annual Plan: $95.88 USD per year ($7.99/month), billed annually

All payments are processed securely through Stripe, a third-party payment processor. By subscribing, you authorize Faithify to charge your chosen payment method on a recurring basis at the then-current subscription rate.

Billing terms:

• Subscriptions automatically renew at the end of each billing period
• You will be charged the applicable subscription fee on the same date each month or year
• Faithify reserves the right to change subscription prices upon 30 days' written notice
• Price changes will not affect your current billing period; they apply at the next renewal
• All prices are in US Dollars (USD) and do not include applicable taxes
• You are responsible for any taxes applicable in your jurisdiction

Faithify may offer a 7-day free trial to new subscribers at its sole discretion. The following conditions apply to free trials:

• Free trials are available to new subscribers only — one trial per household
• A valid payment method is required to start a free trial
• You will not be charged during the trial period
• At the end of the trial, your subscription will automatically convert to a paid plan and your payment method will be charged unless you cancel before the trial ends
• Faithify reserves the right to modify or discontinue free trial offers at any time
• Abuse of the free trial offer (such as creating multiple accounts to obtain multiple trials) will result in immediate account termination

You may cancel your Faithify subscription at any time through your account dashboard or by contacting us at info@faithifyz.com.

Cancellation terms:

• Cancellation takes effect at the end of your current billing period
• You retain access to the Service until the end of the paid period
• No partial refunds are issued for unused portions of a billing period
• Annual subscriptions cancelled after the first 14 days are non-refundable for the remaining period

Refund eligibility:

• Refund requests made within 14 days of the initial annual subscription charge may be considered on a case-by-case basis
• Monthly subscriptions are non-refundable once the billing period has started
• Refund requests must be submitted to info@faithifyz.com with your account email and reason
• All refund decisions are at Faithify's sole discretion

All content, materials, and intellectual property on the Faithify platform — including but not limited to audio recordings, scripts, curricula, lesson plans, graphics, logos, branding, website design, and software — are the exclusive property of Faithify or its licensed content providers and are protected by applicable copyright, trademark, and intellectual property laws.

You expressly agree NOT to:

• Download, copy, reproduce, or record any audio content from the Service
• Distribute, share, broadcast, or publicly perform any Content
• Sell, resell, sublicense, or commercially exploit any Content
• Use any Content to create derivative works without written permission
• Remove or alter any copyright, trademark, or proprietary notices
• Scrape, crawl, or systematically extract data from the Service
• Use automated tools to access the Service without prior written consent

Any unauthorized use of Faithify's intellectual property is a breach of these Terms and may violate copyright, trademark, and other applicable laws, resulting in civil and/or criminal liability.

You agree that you will not use the Service to:

• Violate any applicable local, national, or international laws or regulations
• Impersonate any person or entity, or misrepresent your affiliation
• Transmit any spam, unsolicited communications, or harmful content
• Attempt to gain unauthorized access to any part of the Service or its servers
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent any security, authentication, or access control measures
• Use the Service for any commercial purpose without Faithify's written consent
• Harass, harm, or threaten any individual or group
• Upload or transmit any malware, viruses, or malicious code
• Engage in any activity that damages Faithify's reputation or brand

Faithify takes great care to ensure that all audio content is reviewed by knowledgeable members of the Ethiopian Orthodox Tewahedo Church tradition. However, by using the Service, you acknowledge and agree that:

• All Content is provided for educational and informational purposes only
• Content represents Faithify's interpretation of EOTC teachings and is not a substitute for direct pastoral guidance, official church doctrine, or clergy counsel
• Faithify does not represent or speak on behalf of the Ethiopian Orthodox Tewahedo Church as an institution
• Religious interpretations may vary; users are encouraged to consult their local parish for authoritative guidance
• Faithify makes no warranties regarding the completeness, accuracy, or suitability of any theological content

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FAITHIFY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties that defects will be corrected
• Warranties that the Service or servers are free of viruses or harmful components
• Warranties regarding the accuracy, reliability, or completeness of any Content

Faithify does not warrant that the Service will meet your specific requirements or that the results obtained from using the Service will be accurate or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAITHIFY, ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, business, or goodwill
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from any interruption or cessation of the Service
• Damages resulting from bugs, viruses, or other harmful code
• Any content obtained through the Service

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, Faithify's liability shall be limited to the maximum extent permitted by law.

Faithify's total aggregate liability to you for all claims arising from your use of the Service shall not exceed the total amount you paid to Faithify in the twelve (12) months immediately preceding the event giving rise to the claim.

Faithify is designed to be used by children under parental supervision and account management. The Service is not directed at children under 13 years of age as independent account holders.

Parental responsibilities:

• All accounts must be created and managed by a parent or legal guardian aged 18 or older
• Parents are solely responsible for supervising their children's use of the Service
• Parents are responsible for ensuring the Service is appropriate for their child's age and maturity
• Faithify does not knowingly collect personal information directly from children under 13
• If you believe your child has provided personal information without consent, contact us immediately at info@faithifyz.com

Child profile data (name, age, learning tier) is associated with the parent account and handled in accordance with our Privacy Policy.

By you: You may terminate your account at any time by cancelling your subscription and deleting your account from the dashboard, or by contacting us at info@faithifyz.com.

By Faithify: We reserve the right to suspend or permanently terminate your account and access to the Service, with or without notice and without liability, if we determine in our sole discretion that you have:

• Violated any provision of these Terms
• Engaged in fraudulent, abusive, or harmful conduct
• Failed to pay subscription fees when due
• Provided false or misleading registration information
• Engaged in conduct harmful to other users, third parties, or Faithify

These Terms shall be governed by and construed in accordance with the laws of the United States of America and the state in which Faithify is principally operated, without regard to its conflict of law provisions.

Informal resolution: Before initiating any formal legal proceedings, you agree to first contact Faithify at info@faithifyz.com and attempt to resolve the dispute informally. Faithify will attempt to resolve the dispute within 30 days of receiving your notice.

Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class action waiver: You agree that any arbitration or proceeding shall be limited to the dispute between Faithify and you individually. You waive any right to participate in a class action lawsuit or class-wide arbitration against Faithify.

Faithify reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Send a notification email to your registered email address
• Display a notice on the Service for a reasonable period

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Service and cancel your subscription before the changes take effect.
